Terms of Service

1. Agreement
By creating an account or using marcomauto ("the Platform"), you agree to these Terms of Service. If you are using the Platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms. If you do not agree, do not use the Platform.
2. Accounts
You must provide a valid email address and accurate information when creating an account. You are responsible for maintaining the security of your password and account. You must notify us immediately if you suspect unauthorized access to your account.
One person or entity may operate multiple workspaces (tenants), but each workspace requires its own subscription. Sharing login credentials between multiple people is not permitted. Each team member must have their own account.
3. Subscriptions and Billing
The Platform offers a free Starter plan and paid subscription tiers (Freelancer, Pro, Business, Enterprise). Paid plans are billed monthly or annually through our payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
Upgrades take effect immediately. You will be charged a pro-rated amount for the remainder of your billing period.
Downgrades take effect at the end of the current billing period. You retain access to your current plan features until then. If the new plan has fewer seats than your current team size, you must remove members before the downgrade takes effect.
Cancellation can be done at any time from the billing settings. Your access continues until the end of the paid period. After that, your workspace reverts to the free Starter plan. Your data is not deleted.
Client add-ons are billed monthly per client brand. Adding a client creates an additional charge on your subscription. Removing a client reduces the charge. Client add-on pricing varies by plan tier.
Refunds. New subscriptions are eligible for a full refund within 7 days of the initial purchase. After 7 days, no refunds are issued. Annual plans that are cancelled mid-term are not refunded for unused months; access continues until the end of the paid period. 4. Your Content
You retain full ownership of all content you create on the Platform, including but not limited to: projects, designs, brand assets, images, videos, fonts, graphics, sounds, text copy, and exported files. We do not claim any intellectual property rights over your content.
You grant us a limited license to host, store, display, and process your content solely for the purpose of providing the Platform services to you. This license ends when you delete your content or close your account.
You are responsible for ensuring you have the rights to use any assets you upload (images, fonts, logos, music). We are not liable for copyright or trademark infringement resulting from content you create or upload.
5. Acceptable Use
You agree not to:
- Use the Platform to create content that is illegal, defamatory, hateful, or that promotes violence
- Upload malware, viruses, or malicious code
- Attempt to access other tenants' data or bypass security measures
- Use automated tools to scrape, crawl, or bulk-download content from the Platform
- Resell or redistribute the Platform itself as a competing service
- Share account credentials or circumvent seat limits
- Use the Platform in a way that degrades performance for other users
We reserve the right to suspend or terminate accounts that violate these terms.
6. Team Members and Permissions
Workspace owners can invite team members with different roles (Admin, Editor, Viewer). The owner is responsible for managing their team, setting appropriate permissions, and ensuring team members comply with these terms. Removing a team member deletes their login but preserves their contributed content in the workspace.
The primary owner is the account holder whose payment method is used for billing. Primary ownership can be transferred to another owner within the workspace.
7. Client Brands
Workspaces with client brand add-ons can manage separate brand kits, projects, and assets per client. Each client's data is isolated within the workspace. Team members can be assigned to specific clients, restricting their access to only that client's content.
Deleting a client brand permanently removes all projects, brand assets, and uploaded files associated with that client. This action cannot be undone.
8. Storage Limits
Each plan has a storage limit for uploaded assets (images, videos, fonts, sounds, graphics). If you reach your storage limit, you will not be able to upload new files until you delete existing ones or upgrade your plan. We may send notifications when you approach your limit.
9. Availability and Support
We aim to keep the Platform available 24/7 but do not guarantee uninterrupted access. Scheduled maintenance, infrastructure issues, or third-party outages (Supabase, Moyasar, hosting providers) may cause temporary downtime. We are not liable for losses resulting from downtime.
Support is provided via email. Response times depend on your plan tier. Enterprise plans include priority support and a dedicated account manager.
10. Limitation of Liability
The Platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be error-free, secure, or available at all times.
To the maximum extent permitted by law, our total liability for any claim related to the Platform is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.
11. Termination
You may close your account at any time by contacting support or using the account deletion feature. We may suspend or terminate your account if you violate these terms, with or without notice.
Upon termination, your access to the Platform ceases. Your data is retained for 30 days to allow for recovery, after which it may be permanently deleted. If you are the primary owner, termination of your account affects the entire workspace and all its members.
12. Changes to These Terms
We may update these terms from time to time. If we make material changes, we will notify you via email or a notice on the Platform at least 30 days before the changes take effect. Continued use of the Platform after the changes take effect constitutes acceptance of the updated terms.
13. Governing Law
These terms are governed by the laws of the jurisdiction in which the Platform operator is registered. Any disputes will be resolved through binding arbitration or in the courts of that jurisdiction.
